Is there a possibility of jail time for Driving under suspension-First offense in Ohio ,with no prior offenses?

My boyfriend got into a minor car accident in October 2008. The persons’ insurance company said the damages were 3000.00. My boyfriend didn’t have the money, so stupidly in my opinion,he chose to ignore the situation. He then received notification in the mail in November that his license was in fact suspended. On February 11th of this year he got pulled over for the following: Driving under suspension,Driving with expired plates,Driving without insurance and a seat belt ticket.Needless to say his car was impounded. Anyways, he goes to court in 2 days and he EXTREMELY NEUROTIC about going to jail. Can anybody please give me Info/advice on this matter? He has judge Moore in Cleveland.I would seriously appreciate any input, negative or positive.Thank you.

It is very unlikely he would serve time in jail. Even if this is his first offense DUS, what does the rest of his record look like? If he has some priors then he might get a day or two as a lesson.

There is always a potential for jailtime, the charge is a First Degree Misdemeanor and he could be sentenced to up to 6 months in jail. But I have NEVER heard of anyone getting 6 months, and don’t recall seeing time imposed on a first offense at all.

Tell him to try to make some kind of arrangement regarding the accident and get his license cleared BEFORE going to court if at all possible. That will make a difference to the judge.
